According to the 2022 Special 301 Report by the Office of the United States Trade Representative (USTR), the following Asian and Southeast Asian countries were included in the report’s watchlist:
- China
- India
- Indonesia
- Thailand
- Vietnam
The Special 301 Report is an annual review conducted by the USTR on the state of intellectual property rights (IPR) protection and enforcement in U.S. trading partners around the world. The report identifies countries that do not provide adequate and effective protection of IPR or fair and equitable market access to U.S. persons who rely on intellectual property protection.
Being included in the watchlist means that the USTR will closely monitor the IPR protection and enforcement practices of these countries, and could potentially initiate trade actions against them if their practices do not improve. It also serves as a means of putting pressure on these countries to improve their IPR protection and enforcement policies.

Complementary Strengths
- Complementary strengths: Germany is known for its strong manufacturing and engineering capabilities, while Malaysia is well-known for its skilled workforce, particularly in the areas of electronics and electrical engineering and in IT. This makes the two countries complementary partners in many industries.
- Geographic advantages: Germany is located in the heart of Europe, while Malaysia is strategically located in Southeast Asia. This makes it easier for the two countries to access different markets and customers, and to collaborate on global business projects.
Trade Agreements
Malaysia, as a member state of the Association of Southeast Asian Nations (ASEAN), enjoys numerous business advantages that can help drive economic growth, including:
Access to a population of more than 650 million people, making it one of the largest markets in the world.
Free trade with China, Japan, South Korea, Australia, and New Zealand providing preferential access to these markets, as well as reduced tariffs and other trade barriers.
Business climate
- Cost: One of the primary reasons to extend operations to Malaysia is lower operating costs than in Europe, which could translate to significant savings for a company’s bottom line.
- Proximity to Raw Materials: Malaysia has access to natural resources such as oil, gas, and rubber, which could be used as raw materials in manufacturing. A German company that relies on these resources may find it more cost-effective to move its operations to Malaysia to be closer to the source of these materials.
- Favorable Business Climate: Malaysia has a business-friendly climate, with favorable tax policies and incentives for investors.
- Political Stability: Malaysia is a politically stable parliamentary democracy, with a well-developed legal system. In combination with favourable capital controls and ownership rights, this makes Malaysia a surprisingly familiar business environment.
- Infrastructure: Malaysia has invested heavily in infrastructure, including transportation, telecommunications, and energy, for reliable and efficient supply chains and support operations.
- Language Skills: Malaysia is a multilingual country with a high level of English proficiency, native mandarin, tamil and malay.
